Neal H. Klausner is a partner in the Intellectual Property and Litigation Practice Groups of Davis & Gilbert. He is an experienced trial and appellate lawyer and has handled cases in more than fifteen states and before various government agencies.  His practice includes litigating complex commercial cases in a variety of areas, particularly disputes arising out of advertising, marketing and promotions. Mr. Klausner has extensive experience defending major marketers in state government investigations and class actions alleging deceptive advertising practices; for example, his current and recent representations include defending a well-known publishing company, a marketing solutions provider, and an internet advertising company in state attorney general investigations concerning marketing programs and materials.  He has also represented clients in a broad range of industries in false advertising claims (including class actions alleging false or deceptive practices) brought in state and federal courts throughout the country.  He is also frequently involved in intellectual property litigations, including disputes relating to copyright infringement, misappropriation of ideas, trade dress infringement and dilution, trademark infringement and rights of privacy/publicity. Mr. Klausner has obtained numerous dismissals of these cases.  As a trained mediator, Mr. Klausner has also successfully facilitated the resolution of many of these cases.
